By downloading, installing, or using Kinetic ("the App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the App. We reserve the right to update these Terms at any time, and your continued use of the App following any changes constitutes acceptance of the new Terms.
Kinetic is a mobile fitness tracking application that allows users to log workouts, track progress, set fitness goals, monitor personal records, and review exercise history. The App is intended to serve as a personal fitness journal and does not constitute professional fitness coaching, medical advice, or a substitute for guidance from a qualified health professional.
To use Kinetic, you must create an account by providing accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to register. If we discover that an account has been created by someone under 16, we will terminate that account. You agree to notify us immediately of any unauthorized use of your account.
We collect workout data, body measurements, and fitness goals solely to provide and improve the service. Your data is stored securely using Google Firebase and Google Cloud infrastructure, with encryption in transit and at rest. We do not sell your personal data to third parties. You may delete your account and all associated data at any time from Settings > Privacy & Security. For full details on how we handle your information, please review our Privacy Policy.
You agree to use the App only for lawful purposes and in a manner consistent with these Terms. You will not attempt to access, alter, or destroy data belonging to other users; reverse engineer, decompile, or disassemble any part of the App; upload malicious code or content; use the App to distribute spam or engage in any activity that could damage, disable, or impair the App's infrastructure; or circumvent any access controls or security measures within the App.
Kinetic is not a medical device and does not provide medical advice, diagnosis, or treatment. Calorie estimates, fitness metrics, and progress calculations are approximations and may not reflect your precise physiological response to exercise. You should consult a qualified healthcare professional before beginning any new exercise program, particularly if you have a pre-existing medical condition, injury, or concern. Kinetic is not responsible for any injuries, illness, or adverse outcomes resulting from physical activity you undertake while using the App.
All content, design, code, trademarks, and other materials within the App are owned by or licensed to Kinetic and are protected by applicable intellectual property laws. User-generated content — including your workout logs, body measurements, and goals — remains your property. You grant Kinetic a limited license to store and process that content solely to provide the service. You may not copy, reproduce, or distribute any part of the App without our written permission.
Certain features of the App may require a paid subscription. All purchases are processed through the applicable app store (Apple App Store or Google Play). Subscription fees are charged to your app store account. Cancellations must be made through your app store account settings at least 24 hours before the end of the current billing period. We do not offer refunds for unused subscription periods except where required by law.
The App integrates with third-party services including Google Firebase (authentication, database, storage), Google Sign-In, and Apple Sign-In. Your use of those services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of any third-party service. The App may also optionally integrate with Apple HealthKit and Google Health Connect to read body weight data. Use of these health platform integrations is optional and subject to the respective platform's terms of service.
The App may include leaderboard and social features that allow users to compare workout statistics, achievements, and fitness progress with other users. By using the App, you acknowledge and agree that:
(a) certain fitness data — such as your display name, workout counts, personal records, badges earned, and aggregate performance metrics — may be displayed on in-app leaderboards visible to other Kinetic users;
(b) your participation in leaderboards is governed by the visibility preferences available in your account settings, and you may opt out of appearing on any leaderboard at any time;
(c) if you opt out, your data will be removed from all public-facing leaderboards within a reasonable period;
(d) Kinetic may use anonymized, aggregated leaderboard data for analytics, App improvement, and promotional purposes;
(e) you will not attempt to manipulate leaderboard rankings through fraudulent activity, including but not limited to fabricating workout data, using automated tools, or exploiting bugs in the App; and
(f) Kinetic reserves the right to remove users from leaderboards or suspend leaderboard access for any conduct that violates these Terms or undermines the integrity of the feature. Leaderboard features may be introduced, modified, or discontinued at our discretion, and their availability may vary based on your subscription tier.
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by applicable law, Kinetic and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless Kinetic and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of another party.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the state, or through binding arbitration at the election of either party.
We may update these Terms from time to time to reflect changes in the App, our practices, or applicable law. When we make material changes, we will notify you via the App or by email. Continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App and may delete your account.
